Attorney-General Drops Case Against Kwabena Duffour and Others After Fund Recovery

The Attorney-General has today, Tuesday, 23rd July 2025, officially entered a nolle prosequi to discontinue the criminal case titled The Republic v. Kwabena Duffour & 7 Others (CR/0248/2020).

This case, which formed part of the prosecutions arising from Ghana’s 2018 financial sector clean-up, involved allegations of financial misconduct linked to the collapse of some financial institutions. The State initiated legal action with the dual aim of ensuring accountability and recovering public funds lost during the crisis.

In a statement issued today, the Attorney-General explained that the decision to drop the case was made after the accused persons met a recovery threshold set by the State. Specifically, the Office of the Attorney-General had established a benchmark of recovering at least 60% of the alleged financial losses to reconsider pursuing any such case.

Following extensive negotiations and engagements, the accused persons in this case have satisfied that condition. As a result, the Attorney-General has concluded that continuing the prosecution would not serve any additional public benefit.

This move, however, does not amount to a declaration of innocence. The Attorney-General clarified that the decision is a pragmatic step in the national interest, prioritizing the recovery of funds over prolonged court proceedings.

The Attorney-General reaffirmed his commitment to upholding the rule of law, safeguarding the public purse, and ensuring justice in all matters of national importance.
